📑 Documents Required for Court Marriage & Marriage Registration

⚖️ Documents Required for Court Marriage (Special Marriage Act, 1954)

Court Marriage is solemnized before a Marriage Officer in the presence of three witnesses. The following documents are required from both the bride and groom:

1. Identity & Age Proof (any one of the following)

  • Aadhaar Card

  • Passport

  • PAN Card

  • Driving Licence

  • Birth Certificate

  • School Leaving Certificate / Matriculation Certificate

👉 These documents confirm that the bride is at least 18 years and the groom is at least 21 years old, as required by law.

2. Address Proof (any one of the following)

  • Aadhaar Card

  • Passport

  • Voter ID

  • Driving Licence

  • Utility Bill (Electricity, Water, Gas, Telephone)

  • Rent Agreement

👉 Address proof ensures that one of the parties has resided in the district for at least 30 days prior to giving notice of marriage.

3. Passport Size Photographs

  • 6 to 8 recent color photographs of both bride and groom.

4. Affidavits from Both Parties

Each party must provide an affidavit stating:

  • Full name, date of birth, and parent’s details

  • Marital status (unmarried/divorced/widow/widower)

  • Citizenship and nationality

  • That the parties are not related within the prohibited degree of relationship

5. Special Circumstances Documents

  • If Divorced: Certified copy of Divorce Decree.

  • If Widow/Widower: Death Certificate of the deceased spouse.

  • If Foreign National: Valid VISA, Passport, Proof of stay in India (30 days), and a No Objection Certificate (NOC) from their respective Embassy/Consulate.

6. Witness Documents

Court Marriage requires three adult witnesses. Each witness must carry:

  • Two passport-size photographs

  • Proof of identity (Aadhaar / Passport / Voter ID / Driving Licence)

  • Proof of address


📝 Documents Required for Marriage Registration (After Traditional Ceremony)

If you are already married under Hindu, Muslim, Christian, Sikh, Parsi or any other religious custom, you must register your marriage with the local Marriage Registrar. Documents required are:

1. Identity & Age Proof (for both spouses)

Same as above (Aadhaar, Passport, Birth Certificate, PAN, etc.).

2. Address Proof (for both spouses)

Same as above (Aadhaar, Passport, Driving Licence, Utility Bill, etc.).

3. Marriage Proof

  • Wedding Invitation Card (if available)

  • Photographs of marriage ceremony (1–4 clear photos of key rituals such as garland exchange, pheras, signing of nikah, or religious rites).

👉 This proves that the marriage was solemnized as per religious customs.

4. Joint Marriage Affidavit

A simple affidavit signed by husband & wife, declaring:

  • Date and place of marriage

  • Marital status at the time of marriage

  • That the marriage was performed with free consent

5. Special Circumstances Documents

  • Divorce Decree (if either party is divorced)

  • Death Certificate (if either party is a widow/widower)

6. Witness Documents

  • Two witnesses who attended the wedding ceremony.

  • Each must carry identity proof (Aadhaar/Passport/Voter ID/Driving Licence).

  • Minimum Age: Groom must be 21 years and Bride must be 18 years.

  • Notice Period: For Court Marriage, a 30-day notice is required under the Special Marriage Act.

  • Originals & Photocopies: Carry original documents for verification along with self-attested photocopies.

  • Language: If documents are in regional language, English/Hindi translation may be required.
